How should a liberal democracy respond to the vulnerability of irregular migrants?
Should it expel irregular migrants whenever it finds them? Should it accept them as

The above question forms the basis of Caren’s essay “The Case for Amnesty,” in which he argues that
“[i[rregular migrants should be granted amnesty –allowed to remain with legal status as residents – if
they have been settled for a long time” (2010:6). In explaining his argument he notes: “[t]he moral right
of states to apprehend and deport irregular migrants erodes with the passage of time” (2010: 18). Do
you agree with Caren’s argument? Why/why not? How should a liberal democracy respond to the
vulnerability of irregular migrants?
In preparing to answer this question please read Carens, J. (2010) Immigrants and the Right to Stay
Cambridge: MIT Press. pp. 1-50 (Caren’s essay entitled “The Case for Amnesty”) and responses by
Douglas Massey (pp. 73-79) and Linda Bosniak (pp. 80-92).
In answering this question your essay must provide the following information:
1. SUMMARY OF CARENS’ THE ARGUMENT: Please ensure you provide a detailed summary of
Caren’s main argument and of his supporting points: What does Caren argue? Provide a detailed
summary of at least 3 points or sub-arguments that he gives to support and justify his argument
that irregular migrants be granted amnesty. Evaluate the pros and cons of his arguments.
2. DEBATE: Massey and Bosniak engage with Carens’ arguments providing critical reflection,
support and critique. On what points do Massey and Bosniak agree with Carens? What criticisms
do they raise about his argument? Please be specific and detailed and outline in your own words
the points of agreement and disagreement that both respondents raise regarding his argument.
3. YOUR ASSESSMENT: Do you agree with Caren’s argument? Why/why not? Please support your
argument with well-reasoned arguments, outlining them in a manner similar to Carens, Massey
and Bosniak. In providing an assessment you are free to also use points made by Massey and
Bosniak with which you agree along with any of the readings or discussion from class to help
support your arguments as well.

1. Referencing: Use proper referencing. List any sources that you cite (including proper references for
Johnson, Malkki and Rajaram) alphabetically in the bibliography.
Underline or italicize titles of books and journals.
Article “titles” should be in quotation marks.

3. Formatting: All papers should be double- spaced and typed and not more than 5 pages. Number all
pages and put the bibliography at the end as a separate page (not included as 1 of the 5 pages).
